Terms & Conditions

1. The charter agreement

These terms govern every charter operated by Madame Cruise (DMCA License No. [TBD], Dubai, UAE). A booking is confirmed once we issue a written confirmation and the deposit is received. The lead guest accepts these terms on behalf of the whole group.

2. Booking and payment

  • A 50% deposit confirms your date; the balance is due 7 days before departure.
  • Charters booked within 7 days of departure are payable in full at confirmation.
  • Prices are in AED and include crew, fuel for the published itinerary, and the inclusions listed for your experience. VAT is applied as required by UAE law.

3. Cancellation and refunds

  • By you, 14+ days before departure: full refund of the deposit, or free date change.
  • By you, 72 hours to 14 days before departure: one free reschedule to a date within 6 months; refunds at 50% of amounts paid.
  • By you, within 72 hours of departure (no-refund window): no refund; we will still try to reschedule at our discretion if the yacht can be rebooked.
  • Weather cancellation: if the captain or the coastguard cancels for weather or sea state, you choose between a full refund and a priority rebooking. The captain's safety decision is final and is not a breach of contract.
  • Shared (by-the-seat) departures: these sail only once a minimum number of guests is confirmed. If a departure does not reach its minimum, we will offer you the next available date or a full refund of any seat payment.

4. Safety and conduct

  • Guests must follow crew safety instructions at all times; the captain may end a charter without refund if safety is compromised.
  • Guest counts may not exceed the vessel's licensed capacity. Children remain the responsibility of accompanying adults.
  • No alcohol and no illegal substances are permitted on board. Smoking is limited to designated outdoor areas.
  • Swimming is permitted only at anchor, with crew notified, in the zones the captain designates.

5. Liability

  • Madame Cruise carries passenger liability insurance on every vessel. Our liability is limited to amounts recoverable under that policy and under UAE law.
  • We are not liable for personal items lost, damaged or taken overboard. A safe storage box is available on board.
  • We are not liable for delays or itinerary changes caused by port authority instructions, weather, or other events beyond our reasonable control.
  • Guests with medical conditions affected by sea travel should inform us at booking and consult a physician before sailing. Pregnant guests beyond 28 weeks sail on medical advice only.

6. Privacy on board

Our Privacy Promise forms part of these terms. In return, guests agree not to photograph crew members without their consent and to respect the privacy of other vessels at shared anchorages.

7. Governing law

These terms are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates. Disputes fall under the exclusive jurisdiction of the Dubai courts.
